Acceptance of Terms

By accessing or using the Khoomi marketplace platform, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, you may not access or use our services. These terms apply to all visitors, users, and others who access or use our platform, including buyers, sellers, and artisans. We reserve the right to update or modify these terms at any time without prior notice. Your continued use of the platform following any changes constitutes your acceptance of the revised terms.

User Accounts

To access certain features of the platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding the password that you use to access the platform and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene.

Marketplace Conduct

As a user of Khoomi, you agree to conduct yourself in a professional and respectful manner. You shall not use the platform for any unlawful purpose or in any way that could damage, disable, overburden, or impair our servers or networks. You agree not to attempt to gain unauthorized access to any part of the platform, other accounts, computer systems, or networks connected to the platform. You shall not use the platform to transmit any unsolicited or unauthorized advertising, promotional materials, or spam. Sellers must accurately represent their products and services, provide honest descriptions, and fulfill orders in a timely manner. Buyers must provide accurate shipping information and complete transactions in good faith.

Products and Listings

Sellers are responsible for the accuracy and completeness of their product listings, including descriptions, images, pricing, and availability. All products listed on Khoomi must comply with applicable Nigerian laws and regulations. Prohibited items include but are not limited to counterfeit goods, stolen property, hazardous materials, and items that infringe on intellectual property rights. Khoomi reserves the right to remove any listing that violates these terms or that we deem inappropriate at our sole discretion. Product images must accurately represent the actual item being sold. Sellers must clearly state any defects, modifications, or variations from standard product conditions.

Payments and Fees

All payments on the Khoomi platform are processed through our secure payment system. Prices for products are set by sellers and displayed in Nigerian Naira (NGN). Khoomi may charge service fees for transactions conducted through the platform. These fees will be clearly communicated before any transaction is completed. Sellers agree to Khoomi's fee structure as outlined in the seller agreement. Refunds and disputes are handled in accordance with our refund policy. Khoomi is not responsible for any additional charges imposed by banks or payment providers. All financial transactions are subject to applicable Nigerian tax laws and regulations.

Shipping and Delivery

Sellers are responsible for shipping products to buyers within the timeframe specified in their listings. Shipping costs and estimated delivery times must be clearly stated in product listings. Khoomi facilitates shipping logistics but is not directly responsible for the delivery of products. Sellers must use reliable shipping methods and provide tracking information where available. In the event of lost, damaged, or delayed shipments, sellers and buyers should work together to resolve the issue. Khoomi may intervene in disputes related to shipping and delivery as outlined in our dispute resolution process. Delivery is available across all 36 states of Nigeria and the Federal Capital Territory.

Intellectual Property

All content on the Khoomi platform, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of Khoomi or its content suppliers and is protected by Nigerian and international copyright laws. Sellers retain ownership of their original product designs and creative works but grant Khoomi a non-exclusive license to display and promote their products on the platform. Users may not reproduce, distribute, modify, or create derivative works from any content on the platform without express written permission. Any intellectual property disputes between users should be reported to Khoomi for review and appropriate action.

Limitation of Liability

Khoomi provides the platform on an 'as is' and 'as available' basis. We make no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the platform. To the fullest extent permitted by applicable law, Khoomi shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the platform. Our total liability for any claims arising from these terms or your use of the platform shall not exceed the amount you paid to Khoomi in the twelve months preceding the claim. This limitation of liability applies to the fullest extent permitted by law in Nigeria.
